UK court throws out SFO price fixing appeal

The Court of Appeal in London has rejected an SFO bid to re-open its long running case against five generics firms that it alleged had defrauded the National Health Service (NHS) of £120m through price-fixing.

 

The six-year, £25m ($37m) investigation accused Goldshield, Ranbaxy, Norton Healthcare, Kent Pharmaceuticals and Generics UK of fixing the prices of a range of antibiotics and the blood thinner warfarin.

 

 

 

The Serious Fraud Office (SFO) was attempting to overturn a July decision which ruled that the period under investigation, 1996-2001, was not covered by laws designed to combat cartels that were introduced in 2002.
