MHRA proposes 12 year sentences for counterfeit dealing

The Medicines and Healthcare products Regulatory Agency (MHRA) is planning to strengthen penalties against counterfeiters, making it a specific criminal offence with a maximum sentence of 12 years.

In its latest public consultation document the agency plans to male supplying or offering to supply counterfeit drugs an offence. Currently those caught dealing counterfeit drugs are prosecuted under the Trade Mark Act.

The proposed law would also cover the manufacture, assembly and possession or storage with intent to supply. In the document the MHRA states that many believe the current penalties are limited in scope and fail to provide any deterrent.
